Terms of Service

Elite Functional Health is a brand of Mihaly Fit LLC. Founder Justin Mihaly and Director of Coaching Lindsay Perry lead a coaching team that helps adults understand their physiology and make better lifestyle decisions. Throughout these terms, the words EFH, we, us, and our refer to Elite Functional Health and Mihaly Fit LLC. The words you and your refer to the person using the site or buying a service.

EFH offers educational and informational coaching services. The Bloodwork Review is a paid review of your bloodwork, intake, symptoms, medications, supplements, and goals. Subsequent coaching engagements are educational programs designed to help you train, eat, supplement, and live in a way that supports your goals.

EFH is not a medical practice. EFH does not diagnose, treat, prescribe, or cure any disease, disorder, or medical condition. The review is not a substitute for care from a licensed physician. You agree to consult with your physician before making any decision based on EFH information, including but not limited to changes in medication, diet, training, or supplementation. You assume full responsibility for your health decisions.

You must be at least 18 years old to purchase the EFH Bloodwork Review. By purchasing, you confirm that you are 18 or older, that the information you provide is accurate, and that the lab results you upload are your own.

You agree to provide truthful and complete information on intake forms, quiz responses, and lab uploads. You agree not to misrepresent your medical history, current symptoms, or medications. You understand that incomplete or misleading information will limit the usefulness of the review.

All payments are processed through our payment processor. Once a review has been delivered or a coaching session has been completed, fees are non-refundable. If your circumstances change before delivery, contact support and we will work with you in good faith. Filing a chargeback for a delivered service constitutes a material breach of these terms.

By providing your phone number you consent to receiving operational text messages related to your review. These include appointment confirmations, lab draw reminders, and follow-up touches. Standard messaging rates apply. Reply STOP at any time to opt out. You may withdraw consent at any time by messaging us on Instagram at @efhcoaching.

All content on this site, including the EFH name, marks, written materials, videos, audio, and lab requisition forms, is the property of Mihaly Fit LLC or its licensors. You may not reproduce, redistribute, or resell any of it without our written permission.

To the fullest extent permitted by law, you release Elite Functional Health, Justin Mihaly, Lindsay Perry, Mihaly Fit LLC, and their employees, contractors, and affiliates from liability for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the site, the review, your reliance on any information provided to you, or any subsequent coaching engagement.

You agree to indemnify and hold harmless Elite Functional Health, Mihaly Fit LLC, and the people listed in section 9 from any claim or demand made by any third party arising from your use of the site, your violation of these terms, or your violation of any rights of another.

We may update these terms over time. The updated version will be posted on this page with a new last-updated date. Your continued use of the site after the update is your acceptance of the new terms.

These terms are governed by the laws of the state in which Mihaly Fit LLC is registered, without regard to its conflict of laws principles. Any dispute is to be resolved in the courts of that state.
